Privacy Policy

This privacy policy governs your use of the software application Virtuous Cycle, created by Eat More Pixels Pty Ltd. The app is a bike ride logbook with features to encourage regular bike riding to help promote active transport and sustainable living.

What information does Virtuous Cycle obtain and how is it used?

Virtuous Cycle accesses real-time location information of your mobile device and data from the iOS Health app once you explicitly allow it (using the system-level permissions mechanism).

Virtuous Cycle uses location formation data in order to generate bike ride recording data, such as:

  • Distance
  • Elevation
  • Speed
  • Estimated active calories
  • Estimated carbon savings

In order to estimate a more accurate active calories burned during bike ride, Virtuous Cycle may request read access to sources of data within the iOS Health app (i.e. HealthKit), such as:

  • Body Measurements

The data read from HealthKit is used solely within the app. It is not collected or disclosed outside of your local installation of the app. Only those data types relevant to the app are accessed.

Virtuous Cycle does not transmit data read from HealthKit across the Internet to any server, including our own servers.

Automatically Collected Information

Virtuous Cycle may record anonymous, non-identifying data automatically in order to diagnose and resolve app performance or crashing issues.

Do Third Parties See or Have Access to Information Obtained By The Application

Virtuous Cycle does not transmit any data read from the iOS Health app across the Internet to either our own or any third-party server. Bike ride recording data is only accessible from within the Virtuous Cycle app and is fully controllable by the user.

Virtuous Cycle may display advertisements within the application. These are managed by our own advertising system that does not access any personal information. We don’t show personalised ads within Virtuous Cycle and we don’t use any personal information or perform user tracking for the purpose of advertising.

If you sign-up for a Virtuous Cycle subscription, additional non-personally identifiable data will be kept. Your billing information, address, and name are all maintained by App Store or Play Store and are not visible to us. We will simply get information about whether or not you have purchased a subscription, the term you signed up for and when it is due to expire. This is all made available to us in an anonymous fashion. This anonymous data is also shared with our purchase provider (RevenueCat).

Aggregated, anonymous data is periodically transmitted securely to an external crash reporting service to help us improve Virtuous Cycle. This data is not disclosed to any other third parties, except in the following cases:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • if Virtuous Cycle is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via a prominent notice on this Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

Additionally, these data does not contain any information specific to a user, their real-time location, or their bike ride history.

What are my opt-out rights?

You may opt-out of Virtuous Cycle accessing real-time location information by revoking location permissions in the iOS or Android Settings app.

You may opt-out of Virtuous Cycle reading data from the iOS Health app by revoking permissions in the iOS Health app.

You may opt-out of anonymous analytics collection by Virtuous Cycle by uninstalling the app using the standard iOS or Android app uninstall process.

Personally-Identifying Information

Virtuous Cycle does not gather or transmit any Personally-Identifying Information outside of your local device. Everything is stored locally on your device and is removed if you uninstall the app.

Business Transfers

If Virtuous Cycle, or substantially all of its assets, were acquired, or in the unlikely event that Virtuous Cycle goes out of business or enters bankruptcy, this policy and its effects may change or be amended. (As Virtuous Cycle does not collect any information about you there is very little effect this would likely have in practice.)

Privacy Policy Changes

This Privacy Policy may be updated from time to time, and at Virtuous Cycle’s sole discretion. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy at this URL (http://virtuouscycle.app/privacy). You are advised to consult this Privacy Policy regularly for any changes. Your continued use of this app after any change in this Privacy Policy will constitute your acceptance of such change.

Indemnity

You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including, without limitation, legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of use of this app or any breach by you of any provision of these terms of use, or arising out of any claim that you have breached any provision of these terms of use.

By using Virtuous Cycle, you consent to the processing of your information as set forth in this Privacy Policy.
